What is a Community Property Agreement?

This agreement classifies all property of the spouses as community property with the exception of tax deferred assets such as IRA's, tax-deferred annuities, and pensions. The community property agreement assures double step-up in basis on appreciated assets, with the possible exception of assets classified as community less than one year prior to death.
